A Federal high court sitting in abuja has struck out a suit filed by senator Ned Nwoko challenging the emergence of former delta state governor, senator Ifeanyi Okowa, as the All Progressive Congress, APC, candidate for the delta North Senatorial election. The case, marked FHC/ABJ/CS/1062/2026, had Senator Okowa and the Independent National Electoral Commission, INEC, listed as defendants.
During proceedings, Justice Umar held that the suit was not properly initiated, noting that it was filed through an attorney before Senator Nwoko later attempted to personally regularise the court processes by seeking an amendment.
The defendants objected to the request, insisting that the matter was fundamentally defective from the beginning and could not be salvaged through an amendment. They argued that a case that is incompetent at the point of filing cannot be corrected after the fact.
In his ruling, Justice Umar agreed with the objection and dismissed the application to amend the originating summons. The judge explained that for any amendment to be granted, there must first be a valid and competent suit before the court.
Following that decision, the court struck out the entire case for lack of jurisdiction, bringing the legal challenge to an end at the Federal High Court level.
